Freedom of Information Act

Overview

Santee Cooper is dedicated to complying with the letter and spirit of the South Carolina Freedom of Information Act (FOIA). S.C. Code §§ 30-4-10 to 165 (1976, as amended).  As the FOIA states, "the South Carolina General Assembly finds that it is vital in a democratic society that public business be performed in an open and public manner so that citizens shall be advised of the performance of public officials and of the decisions that are reached in public activity and in the formulation of public policy." § 30-4-15.

In accordance with and in furtherance of the requirements of the statute, Santee Cooper, as a public body, makes its public records available for inspection and copying pursuant to and subject to the limitations of the FOIA. In order to protect open access and ensure timely and appropriate responses to the public, requests for information will be coordinated through Santee Cooper's FOIA Officer.

Board Meeting Schedules, Agendas & Minutes

Approved minutes for the preceding six months are also available for review in person, without a written request, during regular business hours at Santee Cooper’s Headquarters, 1 Riverwood Drive, Moncks Corner, SC  29461.

Request Records Under FOIA

All FOIA requests must be made in writing.  To help ensure we are responsive to your request, you should clearly and specifically describe the records you want.  Include identifying material, names, places and the period of time about which you are inquiring.  We may contact you to clarify your request.  Please note, certain records and documents are exempt from disclosure to the public pursuant to § 30-4-40 and we reserve the right to exempt any applicable information from disclosure.  Requests should be sent to our FOIA Officer via:

Upon receipt, we will reply with an acknowledgement of your request. 

Regardless of the method in which you submit your request, a final determination will be supplied to you within 15 business days from our receipt of the request.  If any records are exempted pursuant to § 30-4-40, we will notify you in this final determination.

If responsive records are available, they will be provided in a form that is mutually convenient and practical for both you and Santee Cooper.  When necessary, the FOIA Officer will coordinate the production or review of the responsive documents with you.  

 

Fees

Section 30-4-30 provides that we may collect reasonable fees to cover the actual cost of searching for and reproducing the records requested.  If we determine that any fees apply, you will be notified prior to document production the amount of the fees and whether a deposit will be required prior to production.

 

Family Privacy Protection Act Notice

The Code of Laws of the State of South Carolina § 30-2-50 provides that no person or private entity shall knowingly obtain or use any personal information obtained from a state agency for commercial solicitation directed to a person in this state. A person knowingly violating this prohibition is guilty of a misdemeanor and subject to the penalties specified in § 30-2-50(D).  

Santee Cooper, as a public body, hereby gives notice to requestors of records from this public body, that obtaining or using these public records for commercial solicitation is prohibited.
